These Terms & Conditions ("Terms") govern your use of the IKanFix service, website and applications (the "Service") provided by The Bestway Digital Ltd ("IKanFix", "we", "us", "our"), a company registered in England and Wales. By accessing or using the Service you agree to be bound by these Terms.
1. The Service
IKanFix provides AI-generated home DIY and repair guidance for UK households, including step-by-step guides, tool lists, shopping lists and planning tools. Guidance is informational only and is not a substitute for a qualified tradesperson where one is required by law (e.g. gas, mains electrical or structural work).
2. Acceptance & eligibility
By using the Service you confirm you are at least 18 years old and have authority to enter into these Terms. Continued use of the Service constitutes acceptance of these Terms and any updates we publish here.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.
4. Acceptable use
You must not:
- use the Service unlawfully or for fraud, spam, or abuse;
- infringe anyone's intellectual property or privacy rights;
- interfere with the Service's security or integrity (malware, probing, scraping, reverse engineering, circumventing technical limits);
- resell or redistribute the Service or its outputs commercially without our written consent.
5. AI-generated content
- You are responsible for your prompts, photos and inputs and for how you use the outputs, including verifying accuracy and safety before acting on them.
- Outputs may be inaccurate, incomplete, or unsuitable for your specific situation. The Service is not a substitute for professional advice (legal, medical, structural, gas, electrical or otherwise).
- You must have the rights to any content you upload.
- We may filter, restrict or refuse outputs, remove content, or suspend accounts that violate these Terms or applicable law.
- Prohibited uses include illegal content, deepfakes, harassment, hate speech, malware generation, and attempts to jailbreak the model.
6. Intellectual property
We retain all rights in the Service, its software, branding and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial DIY purposes within your subscription plan.
7. Payments, subscriptions & taxes
Paid plans (such as the Founding Member plan at £1.99/month) are billed in advance on a recurring basis until cancelled. Payment, billing, tax and invoicing are handled by our reseller, Paddle (see clause 8). Full payment terms are set out in Paddle's Checkout Buyer Terms.
8. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Cancellation & refunds
You can cancel your subscription at any time from the in-app settings (which opens the Paddle customer portal). Refund requests are handled by Paddle in accordance with our Refund Policy.
10. Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination your right to use the Service ends; we may retain or delete your data in accordance with our Privacy Notice.
11. Service availability & warranties
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or meet your requirements. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
12. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or incidental losses, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded under English law.
13. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
14. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service. Continued use after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes, subject to any mandatory consumer protection rights you have in your country of residence.
